"In Bolivia, since the constitutional sentence was issued in 2014, around 500 terminations of pregnancy have been carried out to date on the grounds of rape, foetal malformation and danger to the life and health of the woman," Morales told Urgente.bo.

However, Morales indicated that these figures for termination of pregnancy, compared to the number of rape cases in Bolivia, is a low number because, according to Morales, the country has high rates of sexual abuse.

What the constitutional ruling says

Morales indicated that the Court, in February 2014, issued a constitutional ruling, 0206/2014, which is binding and obligatory and benefits victims of rape, incest and statutory rape for the termination of pregnancy.

In the case of rape, she indicated that an abortion with impunity is available, which means that victims, regardless of their age, can access legal termination of pregnancy. He mentioned that the norm also contemplates the malformation of a foetus, that is to say that it is "incompatible with life".

"Another cause established by the constitutional sentence is the cause of danger to the life and health of the woman, the only requirement for which is a report from the treating doctor, and by secondary legislation, foetal malformation incompatible with life has been increased," Morales said.

According to the director, this sentence has been regularised by the Ministry of Health and it is contemplated how to proceed in the health services. She added that regardless of age, the decision is the victim's and not the family's, referring to the case of the 11-year-old girl who is at least 27 weeks pregnant as a result of rape in Yapacaní.
